General

In principle, you can use our website without providing personal data. 5. Who receives your personal data, and why?

Sharing of data with third parties

Your personal data will only be passed on by us to third parties if this is necessary for the fulfilment of the contract, if we or the third party has a legitimate interest in the passing on of data, if we have your consent for this or if this is necessary for the fulfilment of a legal obligation.

We may disclose personal data to a third party in particular

  • if we are obliged to do so by law or by an enforceable official or court order in a particular case;
  • in connection with legal disputes (vis-à-vis courts or our lawyers) or audits (vis-à-vis auditors);
  • in connection with possible criminal offences vis-à-vis the competent investigating authorities;
  • in case of a sale of the business (vis-à-vis the purchaser).

If data can be regularly transferred to other third parties, this is explained in this privacy policy. In the case of a transmission based on consent, the explanation can also be provided when consent is obtained.

Sharing of data with service providers

We reserve the right to use service providers for the collection or processing of data. Service providers only receive the personal data from us that they need for their specific activities. For example, your e-mail address may be passed on to a service provider so that they can deliver a newsletter you have ordered. Service providers can also be commissioned to provide server capacities. Service providers are usually integrated as processors, who may only process the personal data of the users of this website according to our instructions.

6. When do we transfer data to countries that do not belong to the European Economic Area?

We also transfer personal data to third parties or processors based in non-EEA countries. In this case, we ensure before disclosure that the recipient either has an adequate level of data protection (e.g. on the basis of an adequacy decision by the EU Commission for the respective country in accordance with Art. 45 GDPR, through self-certification of the recipient for the EU-US Privacy Shield in conjunction with the corresponding adequacy decision by the Commission in accordance with Art. 45 GDPR or the agreement of EU standard contractual clauses of the European Commission with the recipient according to Art. 46 GDPR) or the explicit consent of our users has been obtained.

7. How long do we store your data for?

We store your data for as long as this is necessary to provide our website and the associated services or we have a legitimate interest in its further storage. In all other cases, we will delete your personal data, with the exception of data that we must retain to comply with statutory (e.g. tax or commercial law) retention periods (e.g. invoices).

We block data that is subject to a retention period until the expiry of the period.

Specifically, the following retention periods apply to the personal data processed within the scope of this website:

8. Log files (browser information)

Every time you use the Internet, certain information is automatically transmitted by your Internet browser and stored by us for 7 to 10 days to identify malfunctions and for security reasons (e.g. to clarify attempted attacks) and then deleted. Log files whose further retention is required for evidence purposes are excluded from deletion until the respective incident has been finally clarified and may be passed on to investigating authorities in individual cases.

In particular, the following information is stored in the log files:

  • IP address (Internet protocol address) of the terminal device from which the website is accessed;
  • Internet address of the website from which the website was visited (so-called originator or referrer URL);
  • Name of the service provider via which the website is being accessed;
  • Name of the files or information accessed;
  • Date and time as well as duration of the visit;
  • Transferred data volume;
  • Operating system and information on the Internet browser used including installed add-ons (e.g. for the Flash Player); and
  • http status code (e.g. "Request successful" or "Requested file not found").

Log files are also used for web analysis.

 

9. Cookies

This website uses cookies and comparable technologies (hereinafter collectively referred to as "cookies").

What are cookies?

Cookies are small text files which are sent when a user visits a website and are stored in the user's browser. If the corresponding website is called up again, the user's browser sends back the contents of the cookies, thus enabling the user to be recognised again. Certain cookies are automatically deleted at the end of the browser session (so-called session cookies), others are stored in the user's browser for a specified time or permanently and then delete themselves automatically (so-called temporary or permanent cookies).

What data is stored in the cookies?

Essential cookies
These cookies and other information are absolutely necessary for the function of our service. They guarantee that our service will work safely and as you wish. Therefore they cannot be deactivated.

10. Web analysis

We need statistical information about the use of our website in order to make it more user-friendly, to measure reach and to conduct market research.

For this purpose we use analysis tools. The user profiles created by the tools using functional cookies and by evaluating the log files are not combined with personal data. The tools either do not make use of users' IP addresses at all or truncate them immediately after capture.

The providers of the tools generally process data only as processors in accordance with our instructions and not for their own purposes.

Google Tag Manager

This website uses Google Tag Manager. With Google Tag Manager, marketers can manage website tags from one interface. The Tag Manager tool itself (which implements the tags) is a cookie-less domain and does not collect any personal information. The tool triggers other tags, which in turn may collect data. The Google Tag Manager does not access this data. If deactivation has been carried out at domain or cookie level, it will remain for all tracking tags implemented with Google Tag Manager.

Google Analytics

Google Analytics is provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"). We use Google Analytics with the additional function offered by Google to make IP addresses anonymous: In this case the IP address is usually already shortened by Google within the EU and only in exceptional cases in the USA and in any case only saved in truncated form.You can object to the collection or evaluation of your data by this tool by downloading and installing the browser plugin available from the following link: http://tools.google.com/dlpage/gaoptout?hl=de.

 

11. Capture and evaluation of usage behaviour for interests-based advertising (including by third parties)

We would like to offer our users on this website advertising or advertising tailored to their interests. ("interests-based advertising") and to limit the frequency of display of certain advertising.

The usage profiles created by the tools using marketing cookies are not combined with personal data. The tools either do not make use of users' IP addresses at all or truncate them immediately after capture.

The providers of the tools may also pass on information to third parties for the above-mentioned purposes.

You can prevent the creation of usage profiles for interest-based advertising purposes by not giving your consent to the use of marketing cookies in our Consent Management Platform ("CMP") or by withdrawing it. Please note that you are not switching off the advertising by doing this. 12. Your rights (rights of the data subject)

How can you assert your rights?

Please use the information in the Contact section to assert your rights. Please make sure that we can clearly identify you.

Please note that your data will initially only be blocked for use for the original purpose, if deletion conflicts with statutory retention periods.

Your rights to information and rectification

You can request that we confirm whether we are processing personal data relating to you and you have a right to information with regard to your data processed by us. If your data is incorrect or incomplete, you can request that your data be corrected or completed. If we have passed on your data to third parties, we will inform them of the correction, insofar as this is required by law.

Your right to deletion

If the legal requirements are met, you can request that we delete your personal data without delay. This is in particular true if

  • your personal data is no longer required for the purposes for which it was collected;
  • The legal basis for the processing was exclusively your consent and you have withdrawn it;
  • You have objected to the processing for advertising purposes ("advertising objection");
  • You have objected to processing on the basis of the legal principle of legitimate interest for personal reasons and we cannot prove that there are overriding legitimate reasons for processing;
  • Your personal data has been processed unlawfully; or
  • your personal data must be deleted in order to comply with legal requirements.

If we have passed on your data to third parties, we will inform them of the deletion, insofar as this is required by law.

Please note that your right to deletion is subject to restrictions. For example, we do not have to or are not allowed to delete any data that we are required to retain for legal retention periods. Data which we require for the assertion, exercise or defence of legal claims is also excluded from your right of deletion.

 

Your right to restrict processing

If the legal requirements are met, you can demand that we restrict processing. This is in particular true if

  • the accuracy of your personal data is disputed by you, and then until we have had the opportunity to verify the accuracy;
  • The processing is not lawful and you request a restriction of use instead of deletion (see the previous section);
  • We no longer need your data for the purposes of processing, but you need it to assert, exercise or defend your rights;
  • You have objected on personal grounds, and then until it is established that your interests outweigh those of others.

If there is a right to restrict processing, we will mark the data concerned to ensure that it is processed only within the strict limits applicable to such restricted data (in particular to defend legal claims or with your consent).

Your right to the transferability of data

You have the right to receive in a transferable format personal data that you have given us for the fulfilment of the contract or on the basis of your consent. In this case, you can also request that we transfer this data directly to a third party, insofar as this is technically feasible.

Your right to withdraw consent

If you have given us consent to process your data, you can withdraw this consent at any time with effect for the future. This does not affect the lawfulness of the processing of your data up to the point of your withdrawal.

Your right to object on personal grounds

You have the right to object to the processing of your data by us for reasons arising from your particular situation, provided that this is based on the legal principle of a legitimate interest. We will then stop processing your data unless we can - in accordance with the legal requirements - prove compelling reasons for further processing worthy of protection which outweigh your rights, or the processing serves the assertion, exercise or defence of legal claims.

Your right of appeal to a supervisory authority

You have the right to lodge a complaint with a data protection authority. In particular, you can contact the data protection authority responsible for your place of residence or your federal state or the authority responsible for the place where the violation of data protection law took place. Alternatively, you can also contact the data protection authority responsible for us.

 

13. Data protection in the application process

For the processing of applications we collect personal data from applicants. When an employment contract is concluded, this data is stored for the purpose of implementing the employment relationship. The statutory regulations are taken into account. In the event of a decision to reject the candidate, the application documents will be deleted after six months at the latest. An exception to this rule is made if we have to keep the application documents, for example, for the purpose of the duty of proof in proceedings relating to the General Equal Opportunities Act, or if there are other legitimate interests. If we are to include application documents in our pool of applicants on a long-term basis, we will ask for your consent.
